Hilarious considering his tattoos of the band - let alone the fact he recreated the cover in 2016

In an interview with Milanote, Robert Fischer, the designer behind the Nevermind cover, said both he and Cobain had anticipated there could be controversy, and even prepared a version of the artwork with Elden's genitals blurred out.

Cobain countered this with a suggestion to "alleviate the problem" with a custom sticker to cover the area that would read: "If you're offended by this, you must be a closet paedophile," according to an interview he gave to Hot Metal in 1991.

Elden's lawsuit reportedly mentions Cobain's quote directly, noting the album was released without any such sticker. The 30-year-old artist is seeking at least US$150,000 each from all the parties listed on the suit, including surviving band members Dave Grohl and Krist Novoselic, along with Cobain's estate.

Such an obvious, desperate cash grab - but what's really sad is it's such an incrediblly stupid insult to his OWN legacy. "I'm the guy on the Nirvana cover" will go from free beer for life to a punch in the face every time he mentions it now.

I'd be countering with - "dude your cocks just not worth a million dollars - but you can keep the one on the cover" - which, come to think of it, since the serial number can be made out - would probably be worth a good chunk of a million dollars if you owned it.

The Milanote piece is a really great piece too by the way if you've never read it.

The "permanent harm" suffered by Elden includes "extreme and permanent emotional distress with physical manifestations, interference with his normal development and educational progress, lifelong loss of income earning capacity, loss of past and future wages, past and future expenses for medical and psychological treatment and loss of enjoyment of life."

    It sounds like his penis is the same size it was then. Who'd even know it was him if he hadn't have gone around bragging about it? I remember seeing him talk about it on tv a few times and he didn't seem bothered by it then.

  • Excellent point about nobody ever knowing it was him except for his own actions. Even if one of the music sites or whatever had dug it up he could have said no comment and it would likely never have gone much further.

    As much of an eye roll as this is, it's kinda sad this dude's life clearly hasn't panned out where he feels compelled to go this route.


    I wanted to ask Dave to have his lawyers push for a "is this cause you still have a baby dick?" defense but I think this gets laughed out of court before they even get the chance to have a deposition.

  • Maybe someone explains to him how stupid it is, and that he will lose and only end up out of pocket in lawyer's fees - and he grabs a few interview fees and just says "Never mind".

  • Case Closed Forever - so that would have been a nice end to Dave's Wembley trip.

    A US judge has dismissed a man's latest lawsuit against Nirvana over the band's iconic 1991 album cover which showed him naked as a baby.

    Spencer Elden, 31, said his appearance on the front of the Nevermind record constituted child sexual abuse.

    But the judge said he had left it too late to claim he had been exploited.

    Mr Elden's legal avenues are now all but exhausted as he cannot re-file the case, although his legal team told US media he would appeal the ruling.

    The lawsuit focused on a photograph of Mr Elden, which depicted him swimming naked in a pool towards a dollar bill pierced with a fish hook.

    He argued that he had been unable to consent to the picture being used. He was seeking $150,000 (£130,000) in damages.

    Photographer Kirk Weddle was among the defendants, as were former Nirvana members Dave Grohl and Krist Novoselic, as well as Courtney Love, the widow of late singer Kurt Cobain.

    Mr Elden filed his case in 2021, arguing that he was still within his rights to complain about the decades-old image because it had continued to cause him distress and lost earnings into adulthood.

    The lawsuit was dismissed and then re-filed in January.

    The Los Angeles judge ruled on Friday that Mr Elden lodged his case well beyond the 10-year statute of limitations.

    Welcoming the verdict, a defence lawyer said the case had been "meritless".

    The defence had argued that Mr Elden had enjoyed being the "Nirvana baby", noting that he had re-enacted the photograph in later life.

    Mr Elden's parents were paid $200 (£173) for the photo in 1991 by what was then a relatively unknown band.

    Worldwide sales of Nevermind went on to surpass 30 million, making it one of the best-selling albums of all time.
